Is my payment protected?

Terms of Service

1. Acceptance of Terms

By accessing or using the Fixt platform ("Service"), operated by AACG ("Company", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including homeowners, fixers (contractors), and visitors.

2. Description of Service

Fixt is an AI-powered marketplace that connects homeowners with home repair professionals ("Fixers"). The Service includes AI-powered repair diagnosis, competitive bidding, escrow payment processing, in-platform messaging, and related features. Fixt acts as an intermediary platform and is not itself a contractor, home repair provider, or employer of Fixers.

3. User Accounts

You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to create an account. One person may not maintain multiple accounts. We reserve the right to suspend or terminate accounts that violate these terms.

4. Homeowner Terms

Homeowners may post jobs for free. By posting a job, you represent that you have authority to authorize the described work at the specified location. When you accept a bid, you authorize Fixt to place a hold on your payment method for the bid amount plus the platform fee (currently 5%). Payment is released to the Fixer only after you confirm job completion or a dispute is resolved. You agree to review and approve or dispute completed work within 7 days of the Fixer marking the job complete.

5. Fixer Terms

Fixers must maintain a valid subscription ($29/month after the 14-day trial). By joining as a Fixer, you represent that you hold all required licenses and insurance for your service categories in your operating jurisdiction. You agree to perform work as described in the accepted bid. You must carry general liability insurance with minimum coverage as required by your state. Misrepresentation of qualifications, insurance, or licensing is grounds for immediate termination.

6. Payments and Escrow

All payments are processed through Stripe Connect. When a homeowner accepts a bid, the payment amount plus platform fee is authorized and held in escrow. Funds are released to the Fixer upon homeowner approval of completed work. In disputes, Fixt administration reviews evidence and determines fund distribution. Fixt charges a 5% platform fee on each transaction. Fixer subscription fees are billed monthly and are non-refundable for the current billing period.

7. AI Features Disclaimer

Fixt provides AI-powered diagnosis, price estimation, and bid scoring as informational tools only. These features are not substitutes for professional inspection, licensed assessment, or expert opinion. AI diagnoses may be inaccurate and should be used as a starting point, not a definitive assessment. Fixt is not liable for decisions made based on AI-generated recommendations. The AI Value Score is an algorithmic ranking and does not constitute an endorsement or guarantee of any Fixer.

8. Disputes

Either party may initiate a dispute through the platform. Disputes are reviewed by Fixt administration using available evidence including photos, chat logs, job scope, and completion documentation. Fixt's dispute resolution is binding for the purpose of fund distribution within the platform. Fixt's dispute resolution does not prevent either party from pursuing additional legal remedies outside the platform.

9. Prohibited Conduct

Users may not: circumvent the platform to arrange off-platform payments, submit false reviews or ratings, create misleading profiles or qualifications, harass other users, use the platform for unlawful purposes, scrape or data-mine the platform, or interfere with the platform's operation. Violation of these rules may result in account suspension or termination.

10. Limitation of Liability

Fixt is a marketplace platform and is not responsible for the quality, safety, or legality of work performed by Fixers. Fixt does not employ Fixers and is not liable for their actions, negligence, or work product. To the maximum extent permitted by law, Fixt's total liability shall not exceed the amounts paid by you to Fixt in the 12 months preceding the claim. Fixt is not liable for indirect, incidental, special, consequential, or punitive damages.

11. Modifications

We may update these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey. Any disputes arising from these Terms shall be resolved in the courts of New Jersey.
